Membership Agreement
Effective Date: June 2, 2026
This Membership Agreement ("Agreement") is entered into between Elite Martial Arts ("Facility," "we," "us," or "our") and the individual named in the membership application ("Member," "you," or "your"). By signing up for any membership plan, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
1. Membership Plans and Fees
- Plan Selection: You have selected a membership plan as described on our pricing page. All fees are in U.S. dollars and are subject to applicable taxes.
- Payment Authorization: You authorize Elite Martial Arts to charge your designated payment method for recurring monthly dues, initiation fees if applicable, and any incidental charges incurred.
- Price Changes: We reserve the right to modify membership fees with 30 days' advance written notice to active members. Continued use of the facility after such notice constitutes acceptance of the new rates.
2. Membership Term and Cancellation
- Month‑to‑Month: Your membership continues on a month‑to‑month basis until canceled. You may cancel at any time by providing a 30‑day written notice via email to [email protected] or by completing a cancellation form at the front desk.
- Cancellation Effective Date: Your membership will remain active for 30 days following your cancellation notice. You will be charged for any remaining days within that 30‑day period. No refunds are provided for partial months after cancellation takes effect.
- Freeze Option: Members may freeze their membership for medical reasons or extended travel for up to 3 months per calendar year with a doctor's note or proof of travel. No charges will accrue during the freeze period, but the membership term will be extended by the freeze duration.
3. Assumption of Risk and Waiver of Liability
You understand and acknowledge that martial arts, boxing, conditioning, and all related activities involve inherent risks, including but not limited to bodily injury, muscle strains, sprains, fractures, cardiovascular stress, and in rare cases, serious injury or death. You voluntarily assume all risks associated with participation.
To the fullest extent permitted by law, you release, waive, and discharge Elite Martial Arts, its owners, employees, instructors, and affiliates from any and all liability for injuries, damages, or losses arising from your participation, except in cases of gross negligence or willful misconduct on our part.
4. Medical Clearance and Health Warranty
You represent that you are physically able to participate in strenuous exercise and that you have no medical condition that would prevent safe participation. You agree to inform instructors of any injuries, medical conditions, or limitations prior to each class. We recommend consulting a physician before beginning any exercise program.
5. Facility Rules and Conduct
All members must comply with our Class Policies and Code of Conduct. This includes but is not limited to proper attire, hygiene, respectful behavior toward staff and other members, and adherence to safety instructions. We reserve the right to suspend or terminate any membership without refund for violation of these rules.
6. Personal Property
Elite Martial Arts is not responsible for lost, stolen, or damaged personal property. Lockers are available for daily use; you must provide your own lock and remove all belongings after each visit. Unclaimed items will be held for 30 days and then donated or discarded.
7. Photography and Media Release
We may occasionally take photographs or video recordings of classes and events for promotional purposes. By signing this agreement, you grant us the right to use images or footage in which you appear for marketing and social media. You may opt out by providing written notice to management.
8. Entire Agreement
This Agreement, together with any other policies referenced herein, constitutes the entire understanding between you and Elite Martial Arts. No oral representations or modifications shall be binding unless confirmed in writing by an authorized representative.
9. Governing Law
This Agreement shall be governed by the laws of the State of New York without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New York County.
