Welcome to Elite Martial Arts. By accessing our website, enrolling in any class, or using our facility, you agree to be bound by these Terms of Service. Please read them carefully before participating in any activities.
1. Acceptance of Terms
By using our website or services, you acknowledge that you have read, understood, and agree to these terms. If you do not agree, you may not use our website or services. We reserve the right to update these terms at any time, and continued use constitutes acceptance of any changes.
2. Membership and Enrollment
- Eligibility: You must be at least 16 years old to participate in adult classes. Participants under 16 require a parent or legal guardian's consent and enrollment in our Kids Martial Arts program.
- Health and Fitness: You represent that you are in good physical condition and have no medical reason that would prevent you from engaging in physical activity. You must inform instructors of any injuries or medical conditions before participating.
- Payment: All membership fees are due at the time of enrollment and on a recurring monthly basis. We accept major credit cards, debit cards, and ACH transfers. All sales are final except as stated in our Refund Policy.
- Cancellation: You may cancel your membership with 30 days' written notice. Cancellations must be submitted via email to [email protected] or in person at the front desk. No refunds will be given for partial months.
3. Assumption of Risk and Liability Waiver
Martial arts, boxing, and related activities involve inherent risks, including but not limited to bodily injury, muscle strains, sprains, fractures, and in rare cases, severe injury or death. By participating, you voluntarily assume full responsibility for these risks.
To the fullest extent permitted by law, you waive and release Elite Martial Arts, its owners, employees, contractors, and affiliates from any liability for injuries or damages arising from your participation in our programs, unless caused by our gross negligence or willful misconduct.
4. Code of Conduct
All members and visitors must adhere to our Code of Conduct. We maintain a zero‑tolerance policy for harassment, intimidation, violence outside supervised training, and unsportsmanlike behavior. We reserve the right to suspend or terminate any membership without refund for violations.
5. Facility Rules
- Shoes are not permitted on mat areas. Clean indoor shoes may be required for certain areas.
- All equipment must be wiped down after use.
- Personal belongings should be stored in lockers. We are not responsible for lost or stolen items.
- Children must be supervised at all times unless participating in a class.
6. Website Use
Our website is provided for informational and scheduling purposes. You agree not to misuse our site, including but not limited to hacking, scraping, or transmitting harmful code. All content, including text, images, and logos, is our property or used with permission and may not be reproduced without written consent.
7. Intellectual Property
The Elite Martial Arts name, logo, and all related program names are trademarks. Any unauthorized use is prohibited. Training materials provided to members are for personal use only and may not be distributed or copied.
8. Third‑Party Services
We may use third‑party platforms for scheduling, payment processing, and communication. Your use of those services is subject to their respective terms and policies. We are not responsible for their actions or policies.
9. Dispute Resolution
Any dispute arising from these terms or your membership shall be governed by the laws of the State of New York. You agree to attempt informal resolution by contacting us directly before pursuing any formal legal action. Any claims must be brought in the courts of New York County, New York.
